Index Club Ltd – Acceptable Use Policy

These rules govern your use of any products, services, or technologies (collectively, the “Products”) provided by Index Club Ltd (“we,” “us,” “our”) under any subscription or agreement. They exist to protect Index Club Ltd, our customers, and the wider Internet community from unethical, irresponsible, or illegal activity.

By using our Products, you agree to comply with this policy. Breaches may result in service suspension, account termination, and—where required—referral to relevant authorities.

1. Definitions

  • “Customer”: any individual or organization subscribing to or using our Products.

  • “End-User”: anyone who accesses or uses our Products via a Customer’s account.

  • “Member Content”: any data, text, images, code, or other materials submitted by a Customer or End-User.

2. General Use Requirements

2.1 Lawful Purpose Only. You must use our Products in compliance with all applicable local, national, and international laws and regulations.
2.2 Accountability. Customers are responsible for all activity under their account, including actions by End-Users or unauthorized parties if caused by inadequate security.
2.3 Reasonable Security. Customers must implement and maintain appropriate security measures (password controls, access restrictions) to prevent unauthorized access.

3. Fair Use & Capacity

3.1 Normal Business Use. Our Products are offered and billed on the assumption of “business-as-usual” consumption.
3.2 Excessive Use. Usage significantly beyond normal patterns may incur additional fees or temporary capacity limits, at our discretion.
3.3 Anti-Abuse Commitment. We and our Customers must not use Products to harass, discriminate against, or harm any group or individual.

4. Prohibited Activities

4.1 Intellectual Property & Copyright

  • Transmitting, distributing, or storing material that infringes copyrights, trademarks, trade secrets, or other rights without authorization.

  • Using our Products to host or link to pirated or unlicensed content.

4.2 Spam & Unsolicited Messaging

  • Sending unsolicited bulk or commercial messages (“spam”) in violation of applicable laws.

  • Operating unconfirmed “opt-in” mailing or telephone lists. All lists must be confirmed opt-in, with records of consent.

  • Using purchased or third-party lists for unsolicited communications.

4.3 Security Violations & Hacking

  • Attempting to access any system, account, or data for which you have no authorization.

  • Introducing or distributing malware, viruses, or other malicious code.

  • Engaging in network attacks (sniffing, spoofing, flooding, packet injection, denial-of-service).

4.4 Unethical & Exploitative Conduct

  • Facilitating any activity designed to evade payment to Index Club Ltd or other service providers.

  • Unauthorized scraping or harvesting of data about our customers or End-Users.

  • Harassing or threatening individuals or groups, including hate speech or calls to violence.

  • Publishing or linking to content that depicts or promotes child exploitation, terrorism, weapons proliferation, or illicit behavior.

4.5 Illegal or Regulated Activities

  • Using our Products in support of illegal gambling, narcotics or arms trafficking, terrorism, or weapons development.

  • Any conduct that violates export controls or sanctions laws.

4.6 Impersonation & Misrepresentation

  • Impersonating Index Club Ltd, its employees, or affiliates.

  • Misrepresenting any partnership, sponsorship, or endorsement by Index Club Ltd.

5. Member & User Content

5.1 Responsibility. Customers are solely responsible for any Member Content they or their End-Users submit.
5.2 License Grant. By uploading Member Content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display that content for service delivery, promotion, and analytics.
5.3 Termination of License. This license ends when you delete the content or your account, except for materials already used in active promotions or services.

6. Enforcement & Remedies

6.1 Investigation. We may investigate suspected breaches and cooperate with law enforcement.
6.2 Remedial Actions. At our sole discretion, we may suspend or terminate your access, remove offending content, or impose usage limits—without prior notice.
6.3 No Refunds. We are not obligated to refund fees for any suspension or termination resulting from policy violations.

7. Policy Changes

We reserve the right to amend this policy at any time by posting the revised version on https://www.indexclub.co.uk/acceptable-use. The new terms take effect on the earlier of:

  • Your next use of our Products after publication; or

  • 30 days after publication.

Continued use after that date constitutes acceptance of the revised policy.
